Section 01

Interpretation and Definitions

Words with capitalized initial letters have meanings defined under the following conditions. These definitions shall apply whether they appear in singular or plural form.

  • Company — SchoolModernERP, a School Management ERP Software and Educational Technology Service Provider.
  • Application — Any mobile application published, managed, or operated by SchoolModernERP.
  • Website — The official SchoolModernERP website and related web portals.
  • Service — Collectively: Website, Mobile Applications, ERP Platform, Student App, Parent App, Teacher App, and all related services.
  • User — Any individual, school, educational institution, administrator, teacher, parent, student, employee, or organization using the Service.
  • Device — Any device capable of accessing the Service, including computers, laptops, tablets, and mobile phones.
Section 02

Scope of Services

These Terms and Conditions apply to all current and future digital services offered by SchoolModernERP, including:

  • SchoolModernERP Official Website & Mobile Applications
  • School ERP Software Platform & Student Management System
  • Parent, Teacher, and Student Mobile Applications
  • Online Learning and Communication Modules
  • Attendance, Examination, Fee Management, and Administrative Modules
  • Any future digital services offered by SchoolModernERP
By accessing or using any of our Services, you agree to be bound by these Terms and Conditions.
Section 03

User Eligibility

  • Users accessing the Service on behalf of a school or institution must have proper authorization from the institution.
  • Parents or guardians are responsible for accounts created for students under their supervision.
  • The Company does not knowingly permit children under the age of 13 to independently create accounts without school or parental authorization.
Section 04

User Data, Permissions and Privacy

The Application may request access to the following device permissions, used solely to provide intended functionality:

Camera
Storage / Media
Internet Access
Notifications
Location
Microphone

SchoolModernERP may process educational and administrative data including student, parent, teacher information, attendance records, examination data, fee records, and communication records.

  • We do not sell personal data.
  • Data is used only for educational and operational purposes.
  • Reasonable security measures are implemented to protect information.
  • We comply with applicable privacy and data protection requirements.
Users may revoke permissions through device settings at any time. For complete details, refer to our Privacy Policy.
Section 05

Account Responsibilities

  • Maintaining the confidentiality of login credentials.
  • Ensuring information provided is accurate and kept updated.
  • Restricting unauthorized access to their accounts.
SchoolModernERP shall not be responsible for losses arising from unauthorized account access caused by user negligence.
Section 06

Acceptable Use Policy

Users agree not to:

  • Misuse or abuse the Platform in any way.
  • Upload harmful, illegal, or offensive content.
  • Attempt unauthorized access to systems or databases.
  • Disrupt Service operations.
  • Reverse engineer, copy, modify, or redistribute the software without written permission.
  • Use the Service for fraudulent or unlawful purposes.
Section 07

Intellectual Property Rights

All software, source code, designs, interfaces, logos, trademarks, content, and intellectual property associated with SchoolModernERP remain the exclusive property of SchoolModernERP.

No user may reproduce, copy, distribute, or create derivative works without prior written consent.
Section 08

Subscription, Payments and Fees

Schools and institutions may subscribe to services under agreed pricing plans.

  • All fees are payable as per agreed invoices or subscription agreements.
  • Services may be suspended for overdue payments.
  • Prices may be revised upon prior notice.
Section 09

Cancellation and Refund Policy

Unless otherwise specified in a signed agreement:

  • Subscription fees are non-refundable.
  • Setup, implementation, customization, and training charges are non-refundable.
  • Refunds, if applicable, shall be processed at the sole discretion of SchoolModernERP.
Section 10

Third-Party Services

The Service may integrate with third-party providers including Payment Gateways, Video Conferencing Platforms, SMS Providers, Email Service Providers, and Cloud Infrastructure Providers.

SchoolModernERP is not responsible for the content, policies, availability, or performance of third-party services.
Section 11

Data Backup and Availability

We take reasonable measures to maintain service availability and data security. However:

  • Continuous uninterrupted access cannot be guaranteed.
  • Scheduled maintenance may temporarily affect service availability.
  • Users are encouraged to maintain independent backups of important records where appropriate.
Section 12

Termination

SchoolModernERP reserves the right to suspend or terminate access if:

  • These Terms are violated.
  • Payment obligations remain unpaid.
  • Activities threaten platform security or operations.
Termination may result in suspension of access to associated data and services.
Section 13

Limitation of Liability

To the maximum extent permitted by law, SchoolModernERP shall not be liable for indirect, incidental, or consequential damages, loss of profits, loss of business opportunities, or data loss resulting from circumstances beyond reasonable control.

Total liability shall not exceed the amount paid by the customer for the Service during the preceding twelve (12) months.
Section 14

Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. SchoolModernERP makes no warranties regarding:

  • Uninterrupted availability
  • Error-free operation
  • Compatibility with all devices
  • Results obtained from using the Service
Section 15

Children's Privacy

SchoolModernERP provides services primarily through educational institutions. Student information is processed only as necessary for educational administration and communication purposes.

The Company does not knowingly collect personal information directly from children without proper authorization from schools or guardians.
Section 16

Governing Law

These Terms shall be governed and interpreted in accordance with the laws of India.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Uttar Pradesh, India.
Section 17

Changes to These Terms

SchoolModernERP reserves the right to modify these Terms at any time. Updated versions will be published on the Website and/or Application.

Continued use of the Service after updates constitutes acceptance of the revised Terms.
